Clarification Text on the Protection and Processing of Personal Data

This Clarification Text has been prepared by ENMAK Makina Elektrik San. ve Tic. Ltd. Şti. (“ENMAK” or the “Company”), acting as data controller, under Turkish Law No. 6698 on the Protection of Personal Data (“KVKK”), in order to inform you about the purposes for which your personal data is processed, to whom and for what reasons it may be transferred, and your rights in this respect.

1. Data Controller

Your personal data is processed by ENMAK Makina Elektrik San. ve Tic. Ltd. Şti. as data controller, within the scope described below.

2. Personal Data Processed

Depending on the nature of your relationship with our Company, the following categories of personal data may be processed:

• Identity Data: name, surname, title.
• Contact Data: phone number, e-mail address, postal address, fax number.
• Customer/Supplier Transaction Data: request and quotation records, order and contract details, invoice and current account information.
• Marketing and Transaction Security Data: cookie records relating to the use of our website, IP address, browser information, on-site browsing data.
• Request/Complaint Management Data: the content of messages and requests you submit via the contact form, quote form or e-mail.

3. Purposes of Processing Personal Data

The personal data collected is processed for the following purposes, within the conditions set out in Articles 5 and 6 of the KVKK:

• Carrying out request, quotation and order processes relating to our products and services,
• Executing contract processes and fulfilling contractual obligations,
• Conducting customer relations as well as sales and after-sales support activities,
• Carrying out communication activities and responding to your requests,
• Fulfilling financial, accounting and legal obligations,
• Operating our website and ensuring its security and performance,
• Fulfilling obligations arising from applicable legislation and providing information to authorised institutions.

4. Method of Collection and Legal Basis

Your personal data is collected through the contact and quote forms on our website, e-mail, telephone, physical or electronic contracts, and cookies, by automatic or non-automatic means.

This data is processed on the legal grounds that it is directly related to the establishment or performance of a contract, that it is necessary for compliance with a legal obligation, that it is necessary for the establishment or protection of a right, and that it is required for the legitimate interests of our Company, provided that the fundamental rights and freedoms of the data subject are not harmed; where none of these grounds apply, your data is processed on the basis of your explicit consent.

5. Transfer of Personal Data

In line with the purposes stated above and in accordance with Articles 8 and 9 of the KVKK, your personal data may be transferred, to the extent necessary, to our business partners, suppliers, cargo and logistics companies, the providers from whom we receive legal, financial advisory and IT services, and legally authorised public institutions and organisations.

6. Your Rights under the KVKK

Pursuant to Article 11 of the KVKK, by applying to our Company as data controller, you have the following rights regarding your personal data:

• To learn whether your personal data is being processed,
• To request information if it has been processed,
• To learn the purpose of processing and whether the data is used in accordance with that purpose,
• To know the third parties to whom your data is transferred, in Türkiye or abroad,
• To request correction if your data has been processed incompletely or inaccurately,
• To request the deletion or destruction of your data within the conditions set out in the KVKK,
• To request that correction, deletion and destruction operations be notified to the third parties to whom your data has been transferred,
• To object to a result arising to your detriment from the analysis of your data exclusively by automated systems,
• To claim compensation for damages if you suffer loss due to the unlawful processing of your data.

7. How to Apply

You may submit your requests regarding the rights listed above to our Company through the channels below, together with information verifying your identity. Your application will be concluded as soon as possible and within 30 (thirty) days at the latest, depending on the nature of the request.

This Clarification Text may be revised in line with changes in the applicable legislation and updates to our Company’s data processing activities. The current version is published on our website.
